Basic Considerations for doing business in Mexico

This section is not intended to be exhaustive by any means, and should not be used as the basis for any decision in the areas of Mexican commercial and tax laws. Mexican laws are in a constant state of change (Just like in other countries), and, therefore, clients are advised to seek specific professional advice before proceeding with any activities involving Mexico.

When considering doing business in Mexico, the following points are important:

  • Leave your preconceptions at home. Many people have a perception of Mexico that is simply distorted and not accurate. At the same time, it is important to understand the cultural differences relating to how business is carried out and executed.
  • The uniqueness of the tax laws, as well as the variety of legal aspects and the treatment of employees in Mexico (Mexican Employment Law & Mexico Payroll Taxes), are challenging for a foreign company with intentions to come into the country. However we at Human Resources Mexico, S de RL believe that the experience will be rewarding. We can help make things as transparent and as simple possible
  • Take good and trustful professional advice from the beginning. It is less expensive in the long run
  • Determine if you need a permanent establishment or legal presence in Mexico
  • Due diligence is one of the most important key factors just as it is or should be relating to your business activities at home. insist on multiple recommendations and proof of a relevant, successful track record before entering into any form of partnership or working relationship. Make sure you have competent legal and financial representation
  • Have a plan. You should have short term and long term objectives and goals. However, be flexible in as much as the economic situation is changing rapidly throughout the world
  • Among the middle to upper socio-economic class, English is spoken in varying degrees. However, in many companies it’s still common to find executive level employees with limited English ability. A strong grasp of conversational Spanish and cultural awareness go far in demonstrating a genuine interest in Mexico. Obviously, that is the first step toward building lasting relationships in Mexico. If you manage a business with Mexican employees, you will be at a significant disadvantage if you don’t have conversational Spanish ability and knowledge of the cultural differences

Mexican Production Costs Are Lower than China and India
Study by AlixPartners - May 2009

The business consulting and analysis firm AlixPartners has for several years published a study analyzing production costs for offshore manufacturing of goods conducted in different countries. The study takes into account factors such as labor costs, exchange rates, transportation costs, raw materials cost and availability, and customs procedures. In accordance with the study recently published by AlixPartners, in 2008 Mexico gained the top spot for the country with the lowest cost of production, followed by India and China respectively. The study reveals that production costs for similar goods are 25% lower in Mexico than in the United States, while production costs in China are only 6% lower than those in the United States. This is true even though transportation costs increased in the last year. However, such consulting firm considers that Mexico's greatest asset is its strategic location, and the existence of the North American Free Trade Agreement, which provide significant competitive advantages. AlixPartners does not expect Mexico to cede its first place position to either China or India in 2009.
